There is 'inherently' a big problem with trying to write antispam
legislation.

The first big problem comes from the definition of spam and the difference
between what such as US legislators and the CANSPAM act and the Direct
Marketing Association think as distinguished from what antispammers would
like to imagine.

You can't expect to do anything useful about spam with bad legislation and
poor implementation.
