The range of feeding times go from 2 - 5 minutes. A few even say that I should feed them until they're full, which I know is incorrect as they will literally eat until they burst. So I fed them just now with a decent sized pinch of food and timed them. The food vanished in around 45 seconds. Nowhere near even the low-end of the estimates on the various pet care websites. I hope I'm not underfeeding them. I : don't want to over-feed them but I don't want to under-feed them. : : Just now I fed them a pinch a bit larger than a nickel, and they ate it : all in under a minute...so that 5 minutes stuff seems a big high to me.... Following is the response I received from my daughter. As for me the only thing I know about fish involves a cooking pan. I you have any questions I'll pass them along. FP Hello, 14 goldfish is a lot. The typical consideration for number of tank inhabitants is 1" of fully grown fish for every gallon of water. Goldfish are double that amount because they produce a lot of waste. Depending on the variety goldfish will be anywhere from 6" - 14" long fully grown. One 6" goldfish would require 12 Gallons minimum in a tank with standard filtration. You can double the filtration of your tank and reduce the amount to 8 - 10 gallons for a 6" fish, but they might be crowded. Google "goldfish varieties" to see what kind you have. Once you know what kind you have you can check google for goldfish or Koi clubs to get more accurate information on tank requirements and feeding. I would consider checking with local fish stores to see if they'll take some of your fish for store credit or other livestock. If your fish are small enough I would do this in two stages; trade in some now and trade more when they get too big. Don't bring the fish to the store until after they've agreed to see them. I feed once a day just a couple piches of small pellets. They also get a hold of the bloodworms and shrimp I feed my frogs. As long as I change 20% of the water weekly, vacuum the gravel every other week and replace the filters every 3-4 weeks the fish stay healthy and the tank clean. I have learned that there are many other suitable tank mates for goldfish that don't require as much filtration and space. I have a 55G tank with 2 fantail goldfish and 2 african dwarf frogs. I am planning to add one more goldfish. The variety I have will probably reach around 6"- 8". At that point they'll go into the pond. Other tank mates I'm considering are 3 kuhli loaches or 1 dojo loach, 1 cleaner shrimp, 1 japanese trapdoor snail, and a small school of 7-9 1" minnows or same number of danios. All are considered peaceful. The loaches eat leftover food bits and the snail and shrimp eat algae. The minnows and danios are small and school together in the midrange of the aquarium. By adding creatures that help keep the tank clean and considering where their territories are in the tank you are allowed a larger number of total inhabitants. Also, you must add only a few inhabitants at a time to adjust the aquarium to it's new biological load. I use a heater with this setup at 78 degrees. You can also keep peaceful tropical fish with goldfish if you use a heater and keep it at the low end of the tropical fish requirements. I hope this helps :) K From me at privacy.net Wed Mar 4 14:51:35 2009 From: me at privacy.net (Frog Prince) Date: Wed Mar 4 14:55:07 2009 Subject: [Scsocial] A Farmer and His Cow References: Message-ID: A farmer was milking his cow. Message-ID: Below is a snippet from an article I received from Ameritrade today on the current economic crisis and a prediction/analysis on how much longer it may last. The good news: it'll probably be over in about a year or so. The bad news: we're likely to go much, much lower before we recover. The "Growth Fund Guide" quoted is the well known manager (Ken Heebner) of a mutual fund I own, CGMFX. It's done horribly over the last year, it's worst ever 1-Yr Total Return was in 2008, down a whopping -48.18%. Prior to the recent market crash it was the #1 fund over any time period you looked at compared to it's performance with other mutual funds (and that's _any_ type/style of fund, and that's saying something!). It's still the #1 mutual fund over the last 5 year period, despite to tumble it took last year. Not for the faint of heart though, the investing rules of the fund are "there are no rules", the manager can do whatever he wants -- short stocks, go on margin, work any sector with any size company. There's no other fund like it out there...which may be a GOOD thing ;-) Veteran bear says the end is nigh - and that's good MarketWatch 12:06 AM ET NEW YORK (MarketWatch) -- A veteran bear says the end is near -- the end of the great bear market. But we're not quite there yet. In its latest issue, Growth Fund Guide draws elaborate technical parallels with the 1929-1932 bear market. In the short run, it concludes that this year's decline "could last for many more days." But not forever. Putting the stock market in a longer perspective, Growth Fund Guide says, "Since its October 9, 2007 high, the DJIA has appeared to us to be in the process of continuing the major bear market that began in early 2000. Recent price action seems to suggest that we could see one or more declines and advances that could rhyme with [the 1929-32 bear market] ... history is suggesting that that a meaningful low in the U.S. market is most likely to take place within the last six months of 2009 or sometime during 2010." How "meaningful?" Elsewhere, GFG makes it clear: "When we look for a possible low for super bear market, history points to the 18 month time period after June 2009." In other words, it's the big one. And it's close in time, although Growth Fund Guide offers little hint as to how close it is in terms of stock prices. Well, to be fair it's not done like factory farming, and not done with pesticides, but with organic compost, so the work is more labor intensive and the yield might not be as good, so the price is going to be higher. I guess the winter veg is going to be more expensive because it costs money to heat a greenhouse. The veg is beautiful though, not a mark on them, obviously no bugs in the greenhouse either, unlike the spring veg which will have some holes. They're very popular here too, although if I had a family I'd be mystified as to how to make do with *one* kohlrabi, like one of my friends at work got. From the time the first lettuce started coming in, then the swiss chard, then the beans, etc., right on through to the last climbing zucchini at frost, I bought almost no veg at the store, I ate out of the garden all summer. Saved a ton of money and learned many, many different ways to use beans, I had four kinds. This year I am going to attempt fennel -which I've learned hates almost all other vegetables, so it should be interesting trying to grow it in my flower garden.... Heh. Not exactly "time for science to begin" quite yet. First it has to get settled into it's orbit (dunno how long that journey will take), then there will be about 6 weeks of slowly activating systems, like deploying solar panels, the high/low gain antennas, star trackers, etc., and checking out every piece of hardware/software onboard before they can start to obtain real data. Probably be about 2 months before we hear anything from it. The good news is that it launched and separated successfully, that's 90% of the risk gone right there. Message-ID: I appealed a small claims judgment re: the animal hospital that treated my dog for a UTI when she in fact had pneumonia, and I told them that when I got there. Idiot vet ignored the most basic and obvious symptoms of pneumonia and insisted my dog, gasping for air, was suffering from a UTI. So I want my money back, I filed in small claims court but the judge, in the most obtuse way, acknowledged that she misdiagnosed the dog, despite my telling her what was wrong, but said that no malpractice occurred because MY vet, (who correctly dx'd the following day) didn't accuse her of malpractice. The law doesn't say that another vet has to accuse for it to be malpractice, and it's completely stupid to expect one vet to openly accuse another of malpractice. Just TRY to get a doctor to say another made a mistake, it doesn't happen. So my appeal to the state Supreme court was accepted, and now I have to write a brief. Has anyone done this without legal help? It's not complicated, she didn't do her job, I want my money back. The amount is under $500, so not worth getting a lawyer, but I don't want to mess it up either. Has anyone done this before, got any tips for writing a simple but effective brief?? The real, non-smallclaims case seems like something the court is going to expect to be handled 'lawyerly' instead of citizenly. I don't know how it all works in your state; but in my state, small claims are citizen to citizen, no lawyers allowed, but not really so for other courts. Sometimes here smallclaims judges are some kind of 'administrative' (non-judge who is a lawyer) judge and there is a 'process' by which the litigants agree to this kind of administration before there is a smallclaims trial before that administrative lawyer-judge. The important thing about the litigant agreement has to do with what happens about the appeal process - probably because the smallclaims case has never been heard by a real judge so maybe it can't be appealed at all. In any case, apparently you have (maybe) achieved the appeal business/level, but I don't think the court is going to be very happy with either litigant trying to appear in 'real' court without lawyerly familiarity with the system. I'm reading "In New Hampshire, Small Claims Court is not a separate court. Rather, it is a procedure available in District Courts throughout the state and is sometimes referred to as a small claims session." ... so it sounds like your structure is very different from mine. That link^1 doesn't seem to want to give any help on briefs for smallclaims sessions appeals. ^1 http://doj.nh.gov/consumer/scc.html Someplace I found this about NH appeals "Appeals: By either side for review of law, not facts; to Supreme Court within 30 days." ... and the above link sez "On the other hand, the court will not necessarily award costs to a prevailing defendant. Furthermore, the judge's decision is final and no appeal from that decision is permitted unless an objection is raised about the interpretation of the law. Such an objection is appealed directly to the state Supreme Court." So it would seem that your brief would need to be sufficiently lawyerly that it can correctly/ properly/ address how the smallclaims judge did not follow the law -- and not anything about the 'facts' of the case itself. My experiences with smallclaims court in CA have been aided by a Nolo Press book on CA smallclaims court. It was very useful for me to write a very succinct and factual letter about the issues to the other litigant when it began to look like something might end up in small claims court -- the kind of letter which is easy to read, one page, and which the other litigant couldn't really disagree with. Then when it came time for court, I could present that earlier letter to the court because it stated my case well and had been sent to the litigant to try to resolve our differences outside of court, and was easy to read, and when the judge would ask the other litigant if I had sent that letter and if he/they agreed with its basic content or if not how not. It seems like if you had sent a letter to the vet that described your cat and how the diagnosis and treatment seemed to you, a reasonable person, to be so /unreasonable/ as to not deserve payment, that the court might've seen it your way. I'm sorta gloomy about the prospects of your creating a brief that will make a supreme court believe that the smallclaims judge didn't follow the law in the decision. -- Mike Easter kibitzer, not SC admin From borgholio at storymind.com Tue Mar 10 19:58:15 2009 From: borgholio at storymind.com (Borgholio) Date: Tue Mar 10 20:00:10 2009 Subject: [Scsocial] Re: History in the making, starting March 5th. It's simple common sense. The vet spectacularly failed to recognize the most obvious symptoms, even when I told her what the dog had, while proceeding to diagnose the wrong end of the dog where there were NO apparent symptoms, and produced a badly contaminated (and bogus) urine sample to support her dx. A sample taken five hours later, with no medication given, was negative for any bacteria. Fraud or incompetence? I don't care if it's stupidity or more sinister, as in ' they treat a lot of UTI's there', I just don't want to pay for it. Any lay person off the street could have come up with pneumonia listening to her gasp for breath, and unless the vet has a unique dog that breathes out of its ass, she should have had no trouble with that dx. Incomprehensible. > > In any case, apparently you have (maybe) achieved the appeal > business/level, but I don't think the court is going to be very happy with > either litigant trying to appear in 'real' court without lawyerly > familiarity with the system. Unless I request oral argument, which I won't, I don't believe I have to appear in court. I could be wrong but the way I understand it is that the judges will consider the rules of law I appealed on, and if they decide the judge didn't follow the law, they will issue an opinion and I think remand it to him to reconsider. That doesn't thrill me, he wasn't too bright the first time. > > ... so it sounds like your structure is very different from mine. My appeal had to raise questions on the interpretation of the law. #1, he said that there was no malpractice because my vet didn't allege it. There is no law requiring another vet to accuse, the law states that "anyone" may file a complaint, I also said it was unreasonable to expect one professional to openly accuse another of malpractice. #2 was that he misinterpreted the definition of malpractice/misconduct. It's defined in the law as a failure to perform the duties of the job, and she failed completely, also failure to keep medical records (for which she was reprimanded by the vet board). If you don't do the job as the law defines it, then you're guilty of malpractice or as they call it, misconduct. The proof of her misconduct was in the correct diagnosis five hours later, proving that there was pneumonia and there was no UTI, despite her claims of it being the worst she'd ever seen. > > My experiences with smallclaims court in CA have been aided by a Nolo > Press book on CA smallclaims court. Oh, I did better - I went there in person to talk to them and hand deliver my letter stating that in light of the correct diagnosis and their complete failure to even come close, despite my insistences of what was wrong, I expected a full refund, and if I didn't get one, I would be going to Small Claims Court, and regardless of whether they refunded my money, that I would also file a complaint with the vet board. They sent me a letter saying that they wouldn't refund my money because I refused treatment (I didn't, I refused $550 of unnecessary tests, when 1 xray would have sufficed-I begged for a chest xray and they told me she didn't need one, she had a UTI), but also said they hoped it wouldn't prevent me from going back there if I needed emergency help again. ROFL at that one. When I sent a complaint to the vet board, they investigated and during that investigation their story changed three times, the last being the most hilarious. They tried to sell me antibiotics for a UTI that I knew my dog didn't have, so I said no, I wouldn't be paying $37 for antiobiotics she didn't need. They told the vet board that they wished they had explained how antibiotics work (!!) because if I had purchased the antib's for the nonexistent UTI, it would have helped her pneumonia that they refused to diagnose with an xray. How's that for logic. The antib's for UTIs and pneumonia are not even close to being the same. And what's scary is that I said this exact thing to the judge and he still ruled there was no malpractice! > > I'm sorta gloomy about the prospects of your creating a brief that will > make a supreme court believe that the smallclaims judge didn't follow the > law in the decision. > Well, I guess I just have to keep it simple. There isn't any law, or requirement, that my vet has to accuse malpractice, she proved her wrong by easily making a correct diagnosis the next morning. Considering how badly she failed to perform even the most basic observations of obvious symptoms, and the fact that she seemingly doesn't know the arse end from the one that breathes, I think malpractice shouldn't be difficult to conclude. Or so I thought. Barney Frank, who chairs the U.S. House of Representatives Financial Services Committee, told reporters he had spoken to the head of the Securities and Exchange Commission and hoped the uptick rule would soon be reinstated. "I've spoken to Chair Schapiro of the SEC. I am hopeful the uptick rule will be restored within a month," Frank said. The uptick rule, adopted after the 1929 stock market crash, allowed short sales only when the last sale price was higher than the previous price. The SEC abolished the rule in 2007, after concluding that advances in trading strategies rendered it ineffective. Senate Banking Committee Chairman Christopher Dodd said he backed the SEC reinstating the uptick rule "I wish they'd do it quickly," the Connecticut Democrat told reporters. Short-sellers borrow stocks they expect will fall in price in the hope of repaying the loans for less and pocketing the difference. The "short sale" issue is made worse by the practice of "naked short selling", in which the short sellers don't actually borrow the stocks that they short. That is illegal, but the SEC has turned a blind eye to it forever. Naked shorting allows more shares than are available on the market to be bought and sold, which is ridiculous to anyone with common sense. See http://www.nasdaqtrader.com/Trader.aspx?id=RegSHOThreshold for the list of companies that have more shares "in play" than exist in reality. FYI - New York has a single-party consent law. I assume it only applies if all parties are in New York, but basically it means that as long as any one participant in the conversation gives consent, it's okay. You do not need to let the others know it's being recorded. (My lawyer informed me of this many years back, when he suggested that I secretly record conversations with a certain official.) > My thinking record everything if for no other reason then a reference for my > attorney. An interesting aside: my understanding is that if you pay > someone to transcribe, live, the transcription is not considered a violation > of the two party rule. If that's true, I would have to guess that it's because it falls under the same situation as having someone else in the room when you are on speaker phone. (Now, how useful is such a transcription from a legal standpoint, I couldn't say. My guess is the transcript, by itself, would be meaningless without the transcriber.) -- Kenneth Brody From bcs1 at spamcop.net Wed Mar 11 15:38:27 2009 From: bcs1 at spamcop.net (Bill) Date: Wed Mar 11 15:40:08 2009 Subject: [Scsocial] Re: Excitement for one night... How's the health lately? I don't often swing by > here myself these days but I'm in an active period right now ;o) @David Dean & @Skat Health hasn't been too good for quite a few months (actually most of 2008). I'm still 'recovering' from the operation I had back in Jan 2008. I attended a pain management course at St. Thomas Hospital London for 4 weeks in Nov/Dec, which was 'almost' a complete waste of time. (Called the INPUT Pain Management course which I'll tell you about one day). Also, I've been having more problems with the OxyNorm/OxyContin medication (morphine) than I have with my actual back, so have been coming off that stuff very slowly. Found out some pretty good information about the company that manufactures that drug, and reasons behind why they were fined so much for falsifying the drug trials in the US/Australia. I am waiting for a date for 'the final' (yeah right) operation to remove the cage at L5/S1, but it's taking for ever (and will be at least another 12 months most likely). Pretty much limited to weight-bearing for no more than 20mins or else I'm in agony for a week whilst it settles back down. I had to put all my effort into working, so couldn't spend as much time on the various forums I had been, but hopefully, I'm feeling a lot better in the last few months and have more time on my hands. (Rather than having less real work to do and more spare time). Falsifying drug trials? Whaddya mean? Got a link? In any case, you're lucky if you can still get the stuff. Actually, that's for pure oxycodone, not > oxycontin, but I'm guessing that they're connected by the same problem. I'll try and dig out the links later on, but they are quite high up on Google SERP (can't remember search term at the moment). The OxyContin 160mg (timed release version) were the ones initially banned because they had/have such a high street value. The 'druggies' found that by grinding down the 160mg they could make a tidy profit. I forget the actual values of the 'street value per pill' but IIRC it was something ridiculous. It can be snorted, sniffed, injected, etc etc and is fast becoming a new 'designer drug' of choice. In the US they banned production of it party down to the 'abuse' problem, but also due to the negative side effects experienced by regular users. In my reply to SylvesterTheKat, I explain the hassles I had and 'other' issues with the Oxycontin. Don't say I didn't warn ya ! Sylvesterthekat wrote: > > Man what a tale of woe. And you thought much of this had been brought on by > playing rough sports when you were younger right? This is all related to when I fell off that damn innertube on the lake in Oklahoma back in 2001. (Which was being towed behind a speedboat approaching 30+mph at the time). That's how I managed to damage the discs at L5-S1. A friend of mine is the > head nurse at Harrow school and the rugby injuries those boys get are > horrifying and they're only kids! The 15 years plus of Rugby probably didn't help me too much, (along with the motorbike accidents, car crashes, falls, knocks and other associated "good" luck. > > What were the problems you were having with the pain meds? hmmm. where do I start. After the initial operation back in Jan 2008, I was put on morphine whilst in the hospital (IV via a PCA - patient controlled analgesia). They then swapped me over to OxyContin which is a timed release version of Oxycodone Hydrochloride. Straight away I had some reaction to it, which they counteracted with antihistamine and initially those problems settled down. The operation was meant to be to remove the cage between L5-S1, but on opening me up to remove it, they found the the US surgeons had not removed about 30% of the disc and had wedged the cage in against the excess disc. Because of the oblique angle of entry, they could not see the part they had left behind. My surgeon decided that this was probably the reason why the cage was giving me all the problems and decided to remove the excess disc). It was only after a post-op scan that they realised that the cage is either misaligned or, the wrong size which is why it is probably putting pressure on the discs above and below it, and impacting on nerves it shouldn't. But because it is so securely cemented/fixed in place now, to remove it is going to be quite dangerous. (They did tell me 80% chance of paralysis at first). They've now decided that it is causing further damage, and the risk of paralysis from leaving it in, outweighs the danger of doing the operation. I've found a team of surgeons willing to remove it, but organising it all via the good old NHS in the UK is going to take an age. They reckon it will be a good 8-10 hour operation to carefully remove the cage. I don't actually need the cage any more since it's job was only to hold the discs in place until the rods and screws on the posterior fixed in place. But getting back to the morphine issues, over the next few months they gradually increased my dosage to 200mg of OxyContin. And then all of a sudden, my body started to simply reject it. You are meant to get 12 hours of morphine gradually released, but I was getting a big shot whilst it was in the stomach, and very little when it passed through. One of the problems they have found is how it interacts with the lower gut. As with most opiates, it causes constipation, but OxyContin after prolonged usage also effects the gut in other ways. Basically my absorption rate varies from from 10% to 80%, and various other factors will influence this (such as eating aspartame, MSG, and a host of other additives). So I have to go extremely careful about what I eat. (Not that I used to eat a lot of additives as I've always been careful, but you never know what they try and sneak into food these days in order to push up the profit margins). Because the absorption rate varies so much, one day I could be fine, the next day I'd be in withdrawal for 2-3 days, and then I'd get a big shot as it kicked back in, and then withdrawal for a few more days. So I was up and down like a yo-yo. Withdrawal is bad enough, but one of the symptoms is to put my back/lumbar region into spasm, which isn't a good idea when you have a cage in the wrong place to start with. So not only was I suffering from cold turkey at random intervals, I also had an increase in back pain, but with no pain killers to help. This started happening a few weeks after leaving hospital, and initially their solution was to keep increasing the amount of morphine, unaware that this was the cause of the problem in the first place. I did some research online and found that there was a history of this happening with OxyContin, when I presented the information to my GP, she put me in contact with a drug abuse centre and they just said, "Yup, we've seen a massive increase in patients having issues with OxyContin and OxyNorm (the quick release version). She couldn't believe that this wasn't being fed back into the system and that it was still being prescribed. Another negative side effect is that some people build up a massive sensitivity to the drug and you cannot just stop it. The only way to quit taking it, is swap over to OxyNorm and do a gradual step down (10% reduction every two weeks). So now I have to take OxyNorm every 4 hours, 6 times a day. Even with OxyNorm, the absorption rate still varies, but not as much as on the OxyContin. The effects on the gut have always been disputed by the manufacturers, but in the past few months, they have just released a new tablet called Targinact (made by NAPP). This new drug is being marketed on the basis "enables oral naxalone to counteract potential negative effects of the opioid on the bowel. It has been designed to specifically replace OxyContin, OxyNorm, codeine and Tramadol. But specifically engineered to reduce the bowel problems caused by OxyContin. At a recent sales pitch I managed to sneak into, the company rep basically admitted the problems that existed with OxyNorm/Contin and that these were intended to replace them, but wouldn't obviously officially be able to admit to that in public. The marketing hype states "a prolonged-release analgesic combining an opioid agonist with an opioid antagonist." and it's the only one on the market that uses this method. But the new drug has caused some questions to be raised to it's effectiveness. Naxalone is used to counteract opiate overdose, in that because it is an opioid antagonist. It has something to do with the mechanics of how they control the release of the two drugs in conjunction with each other. Some physicians have questioned the controllability of the two given the past track record of how effective OxyContin was with its 'random' release pattern as it passes through the gut. The reason that the company who first licensed the drug in the US/Australia was fined, was down to the fact that they biased the drug trials to give good results. They basically employed former and current drug addicts / prisoners (with drug history) during the trials. They obviously had a higher tolerance to most of the side effects which biased the results. The court records are available online, and I will try and dig them out later on. Currently I'm about 8-12 weeks away from being totally off the OxyNorm, but that leaves me the problem of how to manage the pain. My "pain consultant" wants to put me on methadone, which I am totally against. I just don't react well to opiate based drugs, and this is the second time I've had major issues (first with tramadol and now with Oxycodone). I really did fight to not be given Oxycodone at the start, but was assured it was a new and better drug. > > I hope they sort you out sooner rather than later; I suppose at least > you're not being financially ruined by the whole sorry affair. I'm only just starting to be able to work enough hours in the day to be effective (as witnessed by the 'war and peace' reply I've just created). I still have major back pain and that in conjunction with the drug issues pretty much limits me to a few hours of activity a day. So in order to work, or help around the house, or be a father to my kids, I had to throw all non-essential time use out the window (hence my lack of posting here there and everywhere). But, fingers crossed, things are looking up. I've a new set of 'tools' and techniques to manage the pain without the need for the opiates until such time when I have to go in for the next operation. That has helped me increase the amount of time I can work for during the day.. A developer built his own roads in his development, for which he was responsible, plowing etc. The builder then went bankrupt, and several months previous to that his performance bond lapsed (I still don't know who is responsible for making sure it was in force, the town or the builder). So now the town is stuck with roads that they don't own and don't legally have any right to plow or maintain, the residents can't legally hire anyone, and the builder isn't taking care of his responsibilities either. The town was plowing them and sending the bill to the developer in the interest of public safety, but there was a warrant voted on Tuesday that would have given the Town and Residents rights to pursue relief from the developer. Too bad the bond expired, because I think if the developer is skint, the Town is screwed.... It impacted me last month when my knee was acting up again and I tried to get ten 10mg pills of oxycodone to take the edge off. I can't/don't take tylenol containing painkillers like percocet if at all possible to avoid overstressing my already overworked liver (caused by the detox drugs I'm taking). I'd like to know who makes up these > ridiculous rules. Either ban it or allow it - having quotas is absurd. I'd like to know how they came up with the magic number myself. Did they base it on the sales numbers of previous types of drugs? Did they anticipate the number of people who would immediately switch to the pure form to prevent liver damage from tylenol? (I doubt it!) This rule was put in place by the Bushies, so of course there probably wasn't much logic or real medical advice used. I assume it only applies if : all parties are in New York, but basically it means that as long as any one : participant in the conversation gives consent, it's okay. You do not need : to let the others know it's being recorded. (My lawyer informed me of this : many years back, when he suggested that I secretly record conversations with : a certain official.) To my understanding only the consenting party is required to be in a one party state. : : > My thinking record everything if for no other reason then a reference for my : > attorney. An interesting aside: my understanding is that if you pay : > someone to transcribe, live, the transcription is not considered a violation : > of the two party rule. : : If that's true, I would have to guess that it's because it falls under the : same situation as having someone else in the room when you are on speaker : phone. (Now, how useful is such a transcription from a legal standpoint, I : couldn't say. My guess is the transcript, by itself, would be meaningless : without the transcriber.) All that is required is a notarized statement for submission especially to impeach. That said the other party can depose or cross the transcriber. In a few cases we used a court reporter. In that case we paid the court for the fees which made the recorder an officer of the court. Recall this really twisted the opposing attorney when he found out as it was in court in front of the judge. In one part of western NC the proportion of Baptists has dropped but the absolute number has not. the difference is that Hispanics (predominantly Catholic), Arabs (predominantly Muslim), there were a fair number of Vietnams (Catholic and Budest) and the ringer is a hell of a lot of Mong has gone up exponentally. Message-ID: After the nearly 2 month recovery from the disasterous flood in my basement when the PVC/Copper conversion fitting for the cold water feed to my hot water heater burst, Friday night I went down to the basement to touch up something I had painted earlier in the day and....Reh-roh......found another puddle of water on the floor, coming from _under_ the water heater! I checked the tubing fixes I made, yup they were fine. I cut the power, vacuumed the water up, turned off the main water feed valve, drained the tank, and started investigating for the leak source. I removed the BGE power saver unit from the top of the tank, unscrewed the screws holding the tank lid in place so I could see inside, but the lid wouldn't budge. After chipping away most of the rust from the pipe fittings where the hot/cold water lines enter the top of the tank, I tried to unscrew the 16 year old fittings....no joy, they were welded shut. So I disconnected the "tiger claw" quick disconnect fittings that I used to join the copper/PVC tubing for the previous repair, and desoldered the copper tubing that connects the over-pressure relief valve to the floor drain, then pulled the tank out. I opened up the cover plate to get at the recently replaced (and $$) temp controller and discovered that the fiberglass insulation around it was soaking wet.....DOUBLE REH-RHO! Then I shined a light into the pressure relief valve recess, and saw a bit of water. Removed the valve, cleaned it up, looked at it, the inside was rusted to hell. I suspected that the valve was leaking, but had no idea where or how fast I could get a replacement. Then, realizing that the tank was 16 years old and it might be leaking elsewhere, I decided that I couldn't afford to attempt a repair, have it fail, and suffer another flood. Time for a new water heater. Timing couldn't be better -- I may be losing my LTD benefits next month, already living paycheck to paycheck. FSCK!!! I had to desolder the cold water line w/shutoff valve from the old tank and put it back on the cold water feed so I could at least have cold water, but for some reason I don't understand the uncapped hot water line is dripping water, and duct tape ain't sealing it. I need a rubber cork! The concrete where the tank was located looks suspicious to me, so I have to clean it up and treat it with that mold killer I have. Can't do that unless I can stop that damn hot water line from dripping (I have a bucket on the floor right now). So I called Sears (Kenmore), Lowes (Whirlpool), and Home Depot (GE) for a replacement 50 gallon electric water heater. I briefly looked at BGHhome.com to see what they offered, thinking about maybe converting to a tankless system or a NG powered water heater, but they only sell top of the line stuff and the prices were outrageous. The results: Sears: Entire state of MD sold out of 50 gal. water heaters, had to upgrade to a Kenmore Power Miser 9, 55 gal., Electric Water Heater, which has a crappy 87% efficiency rating. Estimated total cost: $694 (includes $55 installation permit required by my county). However, the cost would be much higher -- their installation plan assumes that you disconnect the old water heater and plop the new one straight in using the existing water lines! Any plumbing work required costs extra. Well shit, if you can't even remove the old lines (and you should expect to on any heater more than 10 years old) you're stuck with an unknown bill. Lowes: Whirlpool 50-Gallon Electric Water Heater, total estimated installation cost $647, including new water lines and permit. Better right? Uh-uh, read on. Home Depot: GE 50 Gallon Electric Medium Water Heater 6YR 4500 Watts. Total installation cost: $745, including new water lines and permit. Ouch. While I'm on the phone with the rep we start talking about the other 2 estimates I got and he gave me the rundown on everything -- Sear's Kenmore products are inferior (I knew that), Lowes lied about hidden extra installation costs that they'd only tell me about once they got to my house (like an extra $40 to take it downstairs, for instance, which Sears did tell me about). Apparently, all three chains use the same company to install their products, so exept for the actual price of the water heater the installation costs would end up being identical regardless of which one I chose. So I placed the order with Home Depot. Damn, I had just finished paying off my CC balance! Back up it goes...... To top it off, I have that damn UNUM required FCE test scheduled for the next two days, so the earliest I can get the new water heater installed is Wednesday -- 5 days without hot water. I just got back from my local gym, sneaked in to shower and shave, which I hadn't done since Thursday night. As an aside, while researching water heaters, I found this interesting tidbit (my county is the only one in MD that doesn't require an expansion tank). I cranked my water pressure valve down another two full turns as a result of reading this, although I don't have a pressure meter installed to check the results: Expansion Tank 101 Signs that you NEED an expansion tank: (in most cases) Public Water Main Line coming in already has a Pressure Relief Valve and a backflow valve But your hot water tank has NO expansion tank Your TPV is leaking esp. with showers/baths When you turn on a faucet an hour or so after shower/bath - it comes out fast Squealing pipes Spike in pressure especially from 80-150 (150 makes the tpv leak!) All the "semi-illegal" extra circuits, outlets, and lights I installed on my own, instead of using a licensed electrician as required by my fscking county just to install a simple outlet, can be ripped out rather easily if I have to do it to sell the house (about 90% of it is in the unfinished basement). Now I'm going to go into a corner and cry a little....I just got a phone call from the installer informing me that as of 2 weeks ago my county started requiring an expansion tank on all new hot water heater installations, at a cost of an additional $120! I'm pissed, to say the least.....for another $100 or so I could have gotten one of those tankless water heaters installed, but I don't have time to call around and find out how much it would cost because of those damn insurance company physical tests I have to take today and tomorrow. *sob* good god, that's one possible mortgage payment I'm going to have to take out of my emergency savings account......one less month of being able to keep my house if l lose my LTD pay.... Yeah, I wish we were near each other too....off the top of my head I don't know any plumber/electricians, but I do have some business cards for guys that have done some work on my house before that might have been able to do the job. I just didn't have the time to waste a day or two looking around. Did I mention that the installation costs more than the damn water heater? And I could have properly done all of the work myself too, except for transporting the new and old tanks up/down the stairs. Oh, I found ANOTHER black mold infestation under the old water heater. Fixed that a couple hours ago, going to Home Depot tomorrow to buy a drip pan to put under the new one so small leaks won't cause another mold problem. And just to make the day even more *satisfying*, I couldn't do the physical part of my Functional Capacity Evaluation test today. I got the news about the extra $120 for the expansion tank right before I left to go to the clinic (voice mail, I was asleep and didn't hear the phone ring this morning), which made me angry and even more anxious about the cost of the job. That, plus the fact that I was very anxious about the outcome of this test (if I pass I lose my LTD pay) made my blood pressure skyrocket. I had it checked about 2 weeks ago by my acupuncturist and it was 127/73, heart rate 70. At the clinic today, they measured it several times, and despite my best efforts at employing relaxation techniques/breathing exercises that have worked in the past to lower my blood pressue, the lowest reading they got was 155/106! That's within a few points of the highest level I've ever had -- some of the testing we did accomplish caused me some pretty bad neck and lower back pain, which always raises my blood pressure. They legally cannot do the physical part of the evaluation (treadmill etc) if the diastolic reading is above 100, so I have to go back next Monday and Tuesday morning to complete the tests. Tomorrow, I have to go see my regular doc and get some blood pressure medicine to at least get me through the FCE test. A friend of mine has to take it and it makes him feel horrible. Shite. I just used my own machine to check my BP and it was still a whopping 164/93, heart rate 80. Just writing about all this crap gets my BP up! Unfortunately they cost a LOT more than I thought when you include installation costs -- several thousand dollars -- BGE's lowest price was $4k! It would take a lifetime for me to recover the excess costs vs. a traditional water heater. I called BGE back this morning to ask about the expansion tank issue and they said they have not been informed about it. They said that they'd be the first to know. After thinking about it, I've had several sinks faucet lines leak from water pressure surges, and then there was the surge that cracked the water heater fitting last Xmas. After reading more about expansion tanks, I firmly believe that the surges were not due to pressure increases in the water feed line, but rather pressure spikes caused by the hot water heater itself. So I'm not going to fight it, I don't want to worry about a basement flood every time I go away for the day/weekend. Yeah, my current body condition is more like an 80 year old man.....although I still look like I'm in my late 30's to early 40's ;-) Thank good genes -- my Dad doesn't look anywhere near his age either.....in fact, now that I think about it, my brothers and sisters all look younger than their real age too, say an average of 10 years younger. I still don't have any wrinkles on my face or hands, for instance. Some grey on the sides, but that's hereditary too -- my grandma's hair turned totally white around age 40, my mother's around 45. My Dad doesn't have much more grey hair than any of his children. A friend of mine almost 10 years younger than me actually started coloring his hair two years ago to hide his greying hair! Bah to that, at least for men ;-) From nobody at spamcop.net Mon Mar 16 21:30:31 2009 From: nobody at spamcop.net (Indigo) Date: Mon Mar 16 21:35:08 2009 Subject: [Scsocial] Re: got one of these Indi? A teebox is usually a slightly (or greatly) elevated grass and dirt platform that you hit your first (tee) shot from on every hole. Under Ashcroft, they put in place a very strict monitoring program to watch individual docs and how much narcotics they were prescribing to try to catch the abusers. They've caught plenty, and just caught another one a few weeks ago in FL. He had dispensed over a million tabs in one year! A lot of docs are _very_ scared to prescribe narcotics now, I can see the hesitation in my own docs faces when I suffer some injury and need painkillers. My dentist in particular has become very reluctant to give me anything, and dental/tooth pain is the worse I ever suffer! To put a > general limit on it is crazy and you'd think the manufacturer would be > having the screaming ab dabs about it. I dunno why the mfg isn't screaming bloody murder about the restriction, unless they're worried about lawsuits from overdoses from illegal consumption (a very real issue IMO). LOL well the announcment of "the Plan" was intriguing... the "dieing leader did live to see earth though, the director reading the news with Baltar and #6 looking over his shoulder was a nice touch, but i didn't quite catch the "you know he doesn't like that name" comment though. did Tricia's face look fatter in that scene? Man Galin was pissed wasn't he? was there a real subtle refernce in there to the location he chose and "gaelic"? did he move to what would later become Ireland? baltar finally showed a little bit of something that wasn't"for himself only" and he showed that he actually had a heart at the end. If they found the bones, why haven't they found the rapters yet? Do you think that the cycle was actually broken by the "fresh start" or was it just delayed when you look at 2,000 vs 150,000 years? Rebates make me crazy. I like to buy computer pieces and parts at dynamite sale prices, which often involves mailin rebates instead of the simplicity of 'instant savings'. I have a 'formal' process by which I prepare for the worst when I get involved with a mail-in rebate. Typically these are from $20-$50 and relate to computer parts which were typically a good deal even without the rebate, but a fantastic deal if you can actually count the rebate. Sometimes one has to question whether or not the 'process' is worth the rebate -- but I think it is if the process itself can be made most efficient -- if I have a regular routine so that my process isn't actually a chore. The typical scenario is that the merchant is Fry's. The rest of the scenario is that there is an online .pdf form which needs to be printed and completed and signed (no notary necessary :-) and a copy of the receipt as well as the excised UPC from the product packaging. For various reasons I routinely make photocopies of all of my Fry's receipts, as well as a 'rough' database or index (a simple text file really) of all of those graphic files for organization. That enables me to easily recover any 'elderly' receipts in case something goes bad way down the road. Sidebar: recent case in point. I purchased a Maxtor 500G SATA/300 drive for a build about a year ago, which was very much on sale. It acted a little funky under various circumstances from the gitgo, but performed and served to install numerous different operating systems over the past year. Its performance gradually deteriorated to the point that eventually (all of a sudden; gradually) it was only being recognized by the BIOS about 20% of the time, and it wouldn't format or perform worth a sh*t. I figgered it was time to figure out my warranty situation. According to Seagate's (Seagate absorbed various things that had absorbed Maxtor) online web gizmo, the drive was out of warranty. But according to my reckoning, I should have at least a year from purchase, and maybe 3. So I began to interact with customer service who immediately wanted me to email them a copy of my receipt. Because of my 'system' or process, that was no problem. Not only did I have a photocopy, but I was actually able to put my hands on the original receipt, which allowed me to rescan it with some gamma correction for clarity. I never would have been able to put my hands on a year old receipt for a computer part without a scanning and filing system. Sure enough, Seagate CS actually granted me a 3 year warranty; and I just sent the drive back in to them. Back to the rebate problem. So rebates involve sending in a pdf, a copy of the receipt, the original UPC carefully dissected from the packaging and then you have to worry about either the postal service losing the mail or the recipient processing service being funky and unreliable. According to all of the literature on the subject, it is definitely not the intention of those who offer rebate deals to actually be paying out rebates. The rebate is supposed to be a come-on, not something the rebater is supposed to have to pay out cold hard cash eventually. They expect the customer to drop the ball one way or the other -- forget to do a process - try to do a process, but f*ck it up - or, if worse comes to worst, the rebate center can always 'lose' that original unreplaceable documentation. Naturally there is still yet *another* /very/ prolonged process that the customer has to perform satisfactorily which is to remember for a great many weeks that they sent off all of this process process 6, 8 or even 12 weeks ago. That means that the customer also has to have yet another process to tickle his recollection that far into the future. My current homemade desk calendar doesn't even have a 12 week advance date on it, as I made it to have 12 months ending in May 2009 -- and/but 12 weeks from now is into June. In addition to all of my other processing, on sizeable rebates such as $50, I consider it to be worth the investment to get a postal proof of mail delivery process. That is not the same as requiring a receipt, which I consider a very very bad idea. That receipt business just screws up the delivery process. If you think not, I'll explain that receipt 'condition' to you in more detail. In any case, what is a lot cheaper and more 'meaningful' (in this instance) than a receipt is simply the post office's process by which they scan the missive and you are able to 'see' (online) that the scanned item has been delivered. And print out that delivery confirmation process which also has an identification number. Except; the cost of that process is 'worthwhile' for a $50 rebate. What about a $7 rebate? Now there's something that will make you crazy. What kind of, how much of, a process of jumping thru' hoops should one have to do for a $7 rebate? Nothing? Don't bother? That doesn't work for me. OTOH, I'm not going to pay for delivery confirmation for a $7 rebate. My newest trick is to mail a duplicate submission; for the cost of a 43cent stamp. Naturally it is missing the original UPC, but it has a copy of that. Plus, it has written all over it in red or blue handwriting that it is a duplicate only to be used in the event of a lost original and not intended to be a request for 2 rebates. Details of the dupe available on request. Clearly I'm taking this rebate game playing way too seriously. -- Mike Easter kibitzer, not SC admin From nobody at spamcop.net Mon Mar 23 20:50:22 2009 From: nobody at spamcop.net (Indigo) Date: Mon Mar 23 20:55:08 2009 Subject: [Scsocial] Found some great new computer apps (long) Message-ID: I was up in PA yesterday to attend my nephew's Eagle Scout award ceremony, then we all went back to my Dad's house to celebrate with pizza and stromboli. I videotaped parts of the ceremony, and used my Dad's ancient (read slow as hell) computer to upload the DV file and burn it to a DVD for my brother. All he had was Windows MovieMaker, which is a sincerely lousy POS A/V app. It took over an hour just to convert/write 15 minutes of digital video to the DVD! At certain points in the process I had to stay at the PC and wait for the next step, so I started perusing his stash of PC World mags. Man, I found a motherlode of Firefox extensions, a super-dooper file manager, a (re)boot speeder-upper, and a great free system analyzer! The all-purpose system app is called JV16 Power Tools, available for free at www.pcworld.com. This thing takes snooping on your system to levels I've never seen before. Besides having a neato "find and delete files with 0 bytes of data" app (which found over 1600 such files on my HD!), it also has a great disk cleaner, even better than ParentoLogic's Privacy Control program that I was crowing about last month for finding hidden files in the Recycle Bin that no other app could find. Well, JV16 found THREE hidden directories in there, PC only had found one of them. And there was tons of items in those secret directories, which had names like S-S-S-1xxxxxx-xxxxx. It also has a registry analyzer that did some amazing tricks. It found a bunch of old entries from previously uninstalled apps, entries that none of the other 3 reg cleaners I have had found. I highly recommend it for anyone with Win2K, XP, or Vista. The file manager is called "FastCopy", also at pcworld.com. It copies or deletes entire directories at lightning fast speed, compared to the way Vista handles file transfers. Cool little app. While you're at the website search for "speed up Firefox" or something similar -- FF was originally written with dialup users in mind, and they never rewrote that part of the code. There are about 5 settings you can change that take the "throttle limiter" off of FF to make it work faster with high-speed connections that most of us have. Some of the changes can made by typing about:config in an empty FF tab, which brings up a configuration dialogue box, and I think one or two adjustments are registry hacks. The app that speeds up the startup of your system from a cold or hot start is called "Startup Delayer" -- it lets you select whatever apps or services you don't need access to right away. It also lets you assign a specific time delay to each item you select. My system startup has become annoying long over the last two years as I've added more and more real-time apps to my PC. All of the apps you have set to start automatically in your startup profile try to start at the same time, which puts a huge burden on the HD and CPU, greatly slowing down everything in the process. It normally took well over a minute to use the PC after Windows was loaded while things like WinMail, WinCalendar, Yahoo Messenger, AVG8, etc. all tried to load and access the net simultaneously. I delayed the startup of about 10 proggies, separated by a minute each, and the boot speed is amazingly fast now. A "must have" for heavy duty users. The FF add-ons I installed are: Fireshot - a very good screen capture app, and built into FF, as opposed to standalone apps you have to load separately like Snagit (which requires a license) or Vista's Snipping tool, which only allows you to save a screenshot as a gigantic BMP file. iMacros - record macros to get to a web page buried inside multiple layers of other pages. For instance, I listen to XM radio on my PC, it takes about 5 steps to get it playing, the macro replaces the URL for the first page and automatically steps thru the website to get the XM player up and running. Very Kewl. Can also be used to autofill the username and PW for https sites. Lazarus Recovery - ever fill out a form or try to post to a messageboard but something goes wrong, and hitting the "back" button to retry you have to start from scratch? Very terrible situation when you've written paragraphs of text! This add-on remembers the contents of the page you had just filled out. Priceless. Session Manager - a recover app for remembering what tabs/windows you had open in FF the last time you used it. Very useful when you've got a whole bunch of tabs open when FF crashes and you have to shut it down via Task Manager, or if you install some updates or hit the wrong button and your PC shuts down without warning. ShopWiki - enter all your information like name, address, email, CC #'s (password protected), and when you go shopping online it automatically fills out all the lines on the order form. Very useful. Toolbar Buttons - one pet peeve of mine is that there is very little you can change on the FF toolbar when you customize it. This app has a whole bunch of useful buttons that you can add to the standard toolbar so you don't have to root thru the drop-down menus to get to commonly used functions. Autocontext - not as whiz-bang as the ones above, but still a bit of a time-saver. When you highlight text on a webpage a dialogue box instantly pops up (no right-click needed) with a whole bunch of options for what to do with the selected text, more options than you get with the right-click too. A couple other ones I added aren't as useful/needed as the ones I listed above, but they include Capture Fox, which will record streaming video, BabelFish, a language translator for when you end up on a non-engrish page, BetterPrivacy, a supreme automatic tracking cookie cleaner, DeskCut, which creates Desktop links from within the context menu, and Enhanced Bookmark Search, which greatly increases the limited capability of FF's built in link search -- a must have for those who have hundreds of bookmarks but have a tough time remembering where you stashed them, like me ;-) From nobody at spamcop.net Mon Mar 23 21:15:02 2009 From: nobody at spamcop.net (Indigo) Date: Mon Mar 23 21:15:07 2009 Subject: [Scsocial] Woot!!! Hopefully being given their freedom breaks the cycle, but then again, that could have been what happened last time too, so we will probably never know. Starbuck has to be real (in some sense), but to what degree, idk, was she real until the crash, then brought back by some divine power 3 months later?, or was she always "an Angel" walking among them? yes, Tory got what she deserved, in a way, it was appropriate, but the timing could have been better because now resurrection is no more... wasn't it Cnl Tigh who said that phrase? but i caught the song too, almost instantly... and i thought they did a great job of tieing it all together the way they did... yes, it was tigh, here's a page on the music... good read http://en.battlestarwiki.org/wiki/The_Music Bill From bcs1 at spamcop.net Thu Mar 26 21:14:19 2009 From: bcs1 at spamcop.net (Bill) Date: Thu Mar 26 21:15:09 2009 Subject: [Scsocial] Re: Did curiosity Kill the Cat?, or did he just LOL at it? Message-ID: Since I started taking BP medicine about 2 weeks ago so I could take that damn FCE test my health has slowly been deteriorating, and today I felt the worst I have in many, many months. Totally brain dead (at my acupuncture session this afternoon I couldn't add 8 + 7 in my head, no joke), felt completely exhausted, nauseas as hell, and every muscle in my body was screaming in pain. Sleep patterns for the last 5 days were all over the place too. I accidentally inhaled some spray paint fumes yesterday, which I'm very sensitive to, so I thought that was why I felt like a truck had hit me overnite. When I first started the med my pulse raced at times (as high as 130), just like a friend of mine when he started taking the exact same ACE inhibitor, but the frequency of them was diminishing quite a bit as my body adjusted to the med (or so I thought). My BP last night was so low (106/58, pulse 87) that I was freezing, and had to put a blanket on my legs and an extra sweatshirt on my torso while watching TV. While getting acupuncture treatment today, my pulse was well over 100 when she started working on me. She got it as low as 80, but it kept bouncing all over the place, between 80-120 during the entire 2 hours. She was very, very worried, and made me call my doctor while she worked on me. I didn't get to talk to him, but I talked to the other doc in his practice and she told me to eat lots of salt tonite, drink lots of fluids, and to get my ass to their clinic ASAP tomorrow (and stop taking the damn BP pills). She almost didn't believe me about the racing pulse problem, she said "well, you'd have to be one in 10,000 people then" -- it's supposedly not a "normal" reaction to the drug. We believe the problem lies in very messed up electrolytes, and that's why my acupuncturist was so worried. ACE inhibitors make your body excrete all electrolytes except for potassium, which it actually helps retain. So achy muscles = cramps from electrolyte imbalance, and racing/bouncing pulse potentially caused by dangerously high potassium levels, which = possible heart attack and/or death. She told me if I felt any heart fluttering, extreme dizziness when standing up from a sitting or prone position, or a very high pulse to call 911 and get to the ER. I can't believe my doctor didn't warn me about ANY of these potentially serious side effects! Thank ghod my acupuncurist also was an RN for 14 years.......this is what happens when you take a drug you DON'T NEED! I have BP spikes when under high stress, not a regularly high BP, dammit!
